RULES AND REGULATIONS OF THE “TO MY DOOR” SERVICE PRIZE DRAW COMPETITION

ARTICLE 1 - ORGANISATION AND DURATION

EUROPCAR INTERNATIONAL, a simplified joint-stock company (Société par Actions Simplifiée) with share capital of €10,880,000, with its registered office in "Le Val Saint Quentin" Business Park, Bâtiment OP, 2 Rue René Caudron, 78960 VOISINS-LE-BRETONNEUX (FRANCE), registered in the VERSAILLES trade and companies register under number B 542 065 305 (hereinafter referred to as "Europcar" or "the Organiser"), is organising, from Monday 18 April 2016 at 00:01 CET to Saturday 30 April 2016 at 23:59 CET, dates and times inclusive, a competition with a prize draw, which is free to enter and without any obligation to purchase, entitled the "ToMyDoor" Service Prize Draw Competition" (hereinafter the "Competition").

ARTICLE 2 - PARTICIPATION

Participation in this competition, which is free to enter and without any obligation to purchase, is open to any person of legal age (hereinafter referred to as "the Participant”), residing in France, Great Britain or Germany, with an Internet connection and an email address.

By participating in the Competition, entrants accept all rules and regulations set out in this document, in addition to any rules of conduct currently applicable on the Internet, and all laws and regulations which apply to free competitions in France.

Only one (1) entry per person will be accepted throughout the entire duration of the Competition.

The participation of any staff or employees (permanent or temporary) of Europcar, its parent companies or subsidiaries, of the VENEZIA-LAVAL-LODIEU-QUILLET study, bailiffs in Neuilly sur Seine (92200), or any immediate family members of the above (ascendant, descendent or spouse) will not be permitted.

Only entries which meet all of the aforementioned stipulations will be accepted. In this regard, the Organiser reserves the right to perform all necessary checks on the identity, age and contact details of each Participant. Any information provided which is incomplete, incorrect, falsified or prevents the Participant from being identified or located, will result in automatic cancellation of the entry.

ARTICLE 3 - PRINCIPLE OF THE COMPETITION

The principle of the Competition is as follows:

-       The Competition will take place from Monday 18 April 2016 at 00.01 CET to Saturday 30 April 2016 at
23.59 CET in the form of a prize draw.

-       An email to launch the Competition will be sent by Europcar to Europcar customers residing in the following countries: France, Great Britain or Germany and who have given their consent in advance to receive such communications (hereinafter the “Europcar Customers”), during week 16 of the year 2016.

-          After receiving and opening the email sent by Europcar, the Europcar Customers will be invited to click on the "Participate" button which will redirect them at random to one of three (3) questionnaires about the Europcar "ToMyDoor" service which have been prepared by Europcar, and are accessible online via the following url links: https://fr.surveymonkey.com/r/delivery-flatrate, https://fr.surveymonkey.com/r/delivery-distance, or https://fr.surveymonkey.com/r/delivery-package.

-          Each questionnaire will be composed of three (3) questions, designed to gauge the Participants' interest in Europcar’s “ToMyDoor” service (hereinafter the “Questionnaire”).

-          The Participants will be invited to respond to the Questionnaire and to complete, for the purposes of the Competition only, and in accordance with the provisions of the law no. 78-17 amended on 6 January 1978 regarding data protection (referred to as the "Loi Informatique et Libertés" or "French Data Protection Law"), the following information on themselves: name, surname, valid e-mail address.

-          The following eligibility conditions apply for participation in the Competition:

o        have responded to the three (3) questions in the Questionnaire. It is specified that there are no right or wrong answers;

o        have completed the whole information requested by Europcar; by Saturday 30 April 2016 at 23.59 CET, hereinafter the “Eligibility conditions”.

All information provided by the Participant (particularly in the Questionnaire) will be processed by Europcar, for the purposes of the Competition and to obtain information on the Participants' interest in Europcar’s “ToMyDoor” service.

The bailiff will supervise the prize draw, which will be carried out among all Participants in the Competition who have met the Eligibility conditions.

From all the Participants who have met the Eligibility conditions for the Competition, one (1) Participant will be drawn and will win the prize as described below in Article 4 of these rules and regulations.

ARTICLE 4 - DESCRIPTION OF THE PRIZE

The following prize (hereinafter the "Prize") has been allocated to the Competition, which will be awarded to the Participant selected from the draw (hereinafter the "Winning Participant") according to the terms and conditions described in Article 3 above:

-    one (1) iPad Air Silver Wi-Fi 16 Go, with a unit value of €399.00 including taxes (three hundred and
ninety-nine euros inclusive of all taxes) (hereinafter the "Prize").

Europcar will not provide any other service or guarantee, and the only benefit received by the Winning Participant will be the Prize.

Europcar shall not be held responsible for any consequences of use of or benefit from the Prize awarded, except as called for in public law.

ARTICLE 5 - AWARDING THE PRIZE

Within a maximum of fourteen (14) calendar days following the prize draw, Europcar will contact the Winning Participant by email to notify them of their success.

The Winning Participant must confirm acceptance of the prize by return email to Europcar within a maximum of fourteen (14) calendar days from the time when they receive the email from Europcar. It is specified that the Winning Participant must provide their postal address in this confirmation email.

If the Participant selected in the draw confirms acceptance of the prize by return email, by the deadline and in accordance with the aforementioned terms and conditions, the Prize will be sent by registered post or by UPS, within a maximum of fourteen (14) calendar days, from the time when Europcar receives the email containing the Winning Participant’s postal address as requested.

If the Participant does not respond or confirm acceptance of the Prize by return email and/or by the deadline or in accordance with the aforementioned terms and conditions, they will lose their entitlement to the Prize, which will then be awarded to the next Participant already selected during the draw, without any right of appeal or entitlement to compensation of any kind.

ARTICLE 6 - MODIFICATION OF THE PRIZE

The prize is not transferable, exchangeable or modifiable, and will not entitle the recipient to any compensation of any form. The Organiser reserves the right to replace the prize announced with an equivalent prize of the same value.

ARTICLE 7 – USE OF THE WINNER’S NAME

The Winning Participant gives the Organiser prior consent to use their name in all activities and events of an advertising or promotional nature, with no entitlement for the former to receive any form of remuneration, right or benefit other than the prize won. If the Winning Participant objects to the use of their details, they must make this known to the Organiser by sending an email to the following address:

ARTICLE 8 - FORCE MAJEURE

In the event of temporary interruption of the Competition for an external reason outside the Organiser’s control, the latter may not be held responsible. The same applies to any social movements, strikes, events, or cases of force majeure, which may give rise to postponement, modification or cancellation of the Competition and the prizes offered. In such circumstances, the Organiser reserves the right to modify, complete, postpone or cancel this Competition and the provisions proposed. The Organiser may not be held responsible as a result of such modifications.

ARTICLE 9 – OBTAINING THE RULES AND REGULATIONS

These regulations are filed with the firm SCP VENEZIA-LAVAL-LODIEU-QUILLET, Associated Bailiffs, based at 130 Avenue Charles de Gaulle, 92200 Neuilly-sur-Seine (92200), and are available for consultation on a dedicated webpage at the following link: http://www.europcar.com/terms-and-conditions/Springprizedraw.

The rules and regulations may be obtained free of charge upon written request to the following address: Europcar International – Service Marketing Produit – Jeu Tirage au sort ToMyDoor – Parc d’Affaires "Le Val Saint Quentin" -
2 rue René Caudron – 78960 VOISINS-LE-BRETONNEUX (FRANCE).

The Organiser agrees to reimburse, upon written request to this effect being sent along with the request to obtain the rules and regulations, any costs incurred for postage related to the request, based on the current second-class postage rate (weight: 20 g).

In any case, all requests which are incomplete, illegible, sent to an address other than that specified above or sent more than ten (10) working days after the closing date of the Competition, as determined by the postmark date, will be considered invalid. Reimbursement will be in the form of postage stamp(s) for a value equivalent (or rounded up to the nearest figure) to the sum to be reimbursed within an indicative period of ninety (90) calendar days following receipt of the request.

In the event of potential extension or postponement of the Competition, the deadline for sending requests to obtain the rules and regulations, and reimbursement of postage and associated costs, will be delayed accordingly.

ARTICLE 10 – CONNECTION AND USE

Europcar reminds participants of the characteristics and limits of the Internet, particularly in terms of technical performance, response times to consult or transfer information, and the risks of contamination through potential viruses circulating on the network. As a result, it denies all responsibility for any consequences experienced by Participants as a result of their Internet connection.

ARTICLE 11 – REIMBURSEMENT OF PARTICIPATION AND CONNECTION COSTS

All Participants in the Competition who have met the conditions for access and participation in the Competition as specified in these rules and regulations may obtain reimbursement for the costs incurred to participate in the Competition, by sending a written request to Europcar International – Service Marketing Produit - Jeu Tirage au sort ToMyDoor – Parc d’Affaires "Le Val Saint Quentin" - 2 rue René Caudron – 78960 VOISINS-LE-BRETONNEUX (FRANCE) by 7 May 2016 at midnight (as determined by the postmark date) or no later than ten (10) calendar days following the date indicated on the relevant invoice of the Internet service provider if this is received by the Participant after the aforementioned deadline.

Reimbursement for communications may be obtained upon written request to the Competition address only if access to the Competition has been via a modem and a telephone line billed on a pro rata basis according to connection time. Reimbursement will be granted based on documents providing proof of the connection time to access the Competition and the rate applied by the Internet service provider.

Any costs incurred in postage of the reimbursement request will be reimbursed upon submission of a written request to this effect together with the request for reimbursement of connection fees, at the current second-class postage rate (weight: 20 g). Reimbursement will be paid by bank transfer within sixty (60) calendar days following receipt of the reimbursement request and after verification of its validity.

The following information must be clearly stated on all requests for reimbursement of participation costs:

–      first name, last name and full postal address of the Participant;

–      the name of the Competition;

–      the connection date and times;

–      a copy of the detailed invoice from the service provider subscribed to by the Participant, clearly highlighting the connection date and times;

–      an RIB (bank account details) or RIP (post office account details) for mainland France.

Only one request for reimbursement per Participant will be accepted (same first name, last name and postal address). The name of the Participant applying for reimbursement must be the same as that indicated on the invoice from the telephone service provider and on the RIB/RIP.

Any requests which are incomplete, illegible and/or sent to a different address other than that of the Competition or sent after the deadline specified above (as determined by the postmark date) will be considered invalid and will not be accepted.

However, as is the case with certain service offers, some Internet providers offer Participants a free or all-inclusive connection, in which case it is expressly agreed that any access to the Europcar webpage containing the Questionnaire and information to be completed, which is performed on a free or all-inclusive tariff (such as a cable, ADSL or dedicated line connection), may not give rise to any form of reimbursement. In cases such as this, the subscription to the Internet service provider's services is taken out by the Participant for their general use of the Internet and no additional costs are incurred by the Participant when connecting to the Europcar webpage containing the form to be completed and submitted for participation in the Competition.

Similarly, no reimbursement will be granted for any IT or electronic material used to participate in the Competition, as the Participants acknowledge and declare to own said material for their own personal use.

ARTICLE 12 – USE OF THE RESPONSES TO THE QUESTIONNAIRE SUBMITTED BY EUROPCAR

The Participants are informed that Europcar will be at liberty to use the generic responses to the Questionnaire to improve its services and/or products as well as those of its group, for which Participants grant authorisation.

ARTICLE 13 – DATA PROTECTION

The personal data collected from each Participant both through participation in the Competition, and in the event of a Prize being awarded, will be used solely for the purposes of management of the Competition by the Organiser, and is subject to the provisions of the French Data Protection Law.

In accordance with the provisions of the French Data Protection Law, Participants have the right to access, amend, correct and withdraw any information concerning them, and they may deny authorisation at any time for its disclosure to third parties by submitting a request in writing to the address indicated in article 1 or by email to:

ARTICLE 14 – DISPUTES

By participating in the Competition, the Participants fully accept these rules and regulations in their entirety. Any claims concerning the Competition must be the subject of an email to the Competition address, indicating the details of the Participant, which must be sent to the Organiser no later than one month after the closing date of the Competition. Any disputes or disagreements on the interpretation or application of these rules and regulations will be settled by the Organiser under the supervision of the bailiff with whom the rules and regulations are filed and after seeking their advice in the matter. The Organiser’s decisions will be final and may not be appealed.

ARTICLE 15 – RESPONSIBILITY

The Organiser may not be held responsible for any consequences of use of or benefit from the Prize awarded, except as called for in public law.

The Organiser reserves the right, for any reason, to shorten, extend, postpone or cancel the Competition, or to modify its access conditions and/or operational procedures. The Participants will not be entitled to any compensation in this regard. Notification of any changes must be provided in advance by any appropriate means. Modifications to the rules and regulations may thus be published during the Competition. Such modifications will be the subject of (an) amendment(s) filed with the firm SCP VENEZIA-LAVAL-LODIEU-QUILLET.

ARTICLE 16 – INTELLECTUAL PROPERTY

All names or brands referred to in these rules and regulations, or on the pages dedicated to the Competition, as well as on any communication medium relating to the Competition, shall remain the exclusive property of their author or the individual who filed them.

ARTICLE 17 –APPLICABLE LAW AND COMPETENT COURTS

This Competition is subject to French law. Attempts will be made to settle any disputes which may arise as a result of the Competition between the Organiser and the Participant amicably. In the event of failure to reach an agreement, the dispute will be brought before the competent courts in accordance with the provisions of the French Code of Civil Procedure. Any claims submitted more than three (3) months after the closing date of the Competition will not be accepted.
